Custom Avatar Policy

01What Is a Custom Avatar?

A Custom Avatar is an AI-generated digital likeness created from a photo or image you upload to the Platform. Revyro uses this image to generate a realistic AI Avatar that can be used across your video Outputs.

Custom Avatars are distinct from stock avatars provided by Revyro. They are created from real human faces and are therefore subject to additional consent, legal, and ethical requirements set out in this Policy.

02Consent Requirement — Non-Negotiable

By uploading a photo to create a Custom Avatar, you represent, warrant, and confirm that:

• If the photo is of yourself: You are the individual in the photo and you consent to your own likeness being used to create an AI Avatar for commercial advertising purposes on the Platform.
• If the photo is of another person: You hold a valid, signed consent agreement from that individual, specifically authorising the use of their likeness to create an AI-generated Avatar, the use of that Avatar in commercial video advertising, and the distribution of that advertising content on digital platforms (TikTok, Instagram, YouTube, and others).

03Who Can and Cannot Be an Avatar

Permitted

• Yourself, with your own consent
• Professional actors, models, or employees who have signed a valid consent agreement specifically for AI avatar use in commercial advertising
• Any individual who has provided written, informed consent as described in Section 2

Strictly Prohibited

• Celebrities and public figures — regardless of how their image was obtained
• Politicians, athletes, or any individual with public recognition — unless they have provided explicit written consent
• Minors under the age of 18 — under any circumstances, with no exceptions
• Deceased individuals — without legal authorisation from the estate
• Any individual who has previously requested removal of their likeness from the Platform

Violations of this section will result in immediate account termination.

04Quality & Technical Requirements

To create a high-quality Custom Avatar, the uploaded photo should meet the following guidelines:

• Clear, well-lit, front-facing image of the individual
• High resolution (minimum 512 × 512 pixels recommended)
• Unobstructed view of the face — no sunglasses, heavy shadows, or masks
• Neutral or natural expression for best results
• The individual should be the primary subject of the photo

Revyro does not guarantee Avatar quality if uploaded images do not meet these guidelines.

05Ownership & Usage Rights

5.1 Who Owns Your Custom Avatar

You retain ownership of the source photo you upload. Revyro generates the Avatar from your photo and assigns all rights in the generated Avatar to you, subject to your compliance with these Terms and an active Subscription.

5.2 How You Can Use Your Custom Avatar

Your Custom Avatar may be used:

• Across multiple video Outputs generated on the Platform
• In commercial advertising on digital platforms (TikTok, Instagram Reels, YouTube Shorts, Facebook, and similar)
• For the duration of your active Subscription

5.3 How You Cannot Use Your Custom Avatar

You may not:

• Export, download, or use the Avatar data outside of the Platform
• Transfer, sell, sublicense, or share your Custom Avatar with third parties
• Use the Avatar in contexts that violate the Terms of Service or this Policy
• Use the Avatar after your Subscription has been cancelled or terminated

5.4 Revyro's Licence

By uploading a photo and creating a Custom Avatar, you grant Revyro a limited, non-exclusive licence to store and process the Avatar data solely for the purpose of generating your Outputs. Revyro will not use your Custom Avatar to train AI models or for any other purpose without your explicit consent.

06Storage & Retention

You may request deletion of your Custom Avatar and source photo at any time by contacting support@revyro.io. We will process deletion requests within 72 hours.

07Biometric Data Notice

The processing of facial images to generate a Custom Avatar may constitute processing of biometric data under applicable law, including:

• GDPR (EU) — classified as special category data under Article 9
• Illinois Biometric Information Privacy Act (BIPA) — USA
• Other US state biometric privacy laws (Texas, Washington, etc.)

By creating a Custom Avatar, you:

• Provide explicit consent to the processing of facial biometric data for Avatar generation purposes (GDPR Article 9(2)(a))
• Confirm that any third-party individual whose face is used has also provided explicit consent
• Understand that you may withdraw consent and request deletion at any time

08Takedown & Removal Requests

Any individual who believes their likeness has been used to create a Custom Avatar on the Platform without their consent may submit a takedown request to:

Please include:

1. Your full name and contact information
2. A description or link to the content in question
3. Proof of identity
4. A statement confirming you did not consent to this use of your likeness

We will review and act on all valid requests within 5 business days. The account responsible will be investigated and may be suspended or terminated.

09Revyro's Disclaimer

Revyro provides a technical platform for AI Avatar generation. We do not verify consent agreements, assess the legality of uploaded images, or monitor how Avatars are used once generated.

You are solely and fully liable for:

• Ensuring you hold all required consents before creating any Custom Avatar
• Compliance with all applicable laws governing the use of a person's likeness
• Any claims, damages, or legal action arising from the creation or use of a Custom Avatar without proper consent

Revyro reserves the right to remove any Custom Avatar and terminate any account if we receive a valid complaint or become aware of a violation of this Policy.
